Preamble

 

The purpose of these general conditions of use (hereinafter referred to as the ‘GCU’) is to determine the rules for use of the ‘Ostend Airport’ mobile application published by UBIPLACE. Use of the Service is optional and free of charge (excluding connection costs).
Any use of the Service implies consultation and acceptance of these general conditions of use (GCU). By installing the application on your terminal and/or by accessing the application, as a visitor and/or user, you unconditionally and unreservedly accept the entirety of the GCU defined below.

 

Article 1. DEFINITIONS 

Ostend Airport is available free of charge in Apple’s ‘Apple Store’ and Google’s ‘Google Play Store’ to be downloaded by users onto their Apple iOS and Android devices. Ostend Airport also includes content, software, programs, tools (programming, navigation, etc.), databases, operating systems, documentation and all other elements and services of which it is composed, as well as updates and new versions that may be brought to Viability by UBIPLACE.

 

Article 2. PURPOSE OF THE APPLICATION

The purpose of Ostend Airport is to give you access to information and services offered by UBIPLACE. 

 

  • A number of services are available to users, including :
  • Provide qualified information on the state of the infrastructure;
  • Offer subscription to alerts on anomalies or malfunctions detected;
  • Allowing free subscription to inspection reports to keep abreast of developments in incidents or interventions;
  • Be kept informed of events or interventions in progress or to come in the monitored zones;
  • Collect real-time data on the status of sites and work in progress.

 

This list may be modified at any time by UBIPLACE without UBIPLACE being held liable in any way whatsoever.

 

Article 3. ACCESS TO THE APPLICATION

 

To access and use the Ostend Airport application, you need a compatible phone or mobile device and access to the Internet.

Ostend Airport can be downloaded free of charge from the Apple Store and Google Play Store on the following mobile devices:

– Apple® Iphone® mobile phone running iOS 11 or higher
– Android® OS 4.2 or higher mobile phone
The software version of Ostend Airport may be updated from time to time to add new functions and services.

The software version of the Application may be updated from time to time to add new functions and services.

 

ARTICLE 4. USER LICENCE

 

UBIPLACE grants you a personal right to use the Application and its content. This right is granted on a non-exclusive, revocable, non-assignable, non-transferable, worldwide and free basis and for the sole use of the Application, to the exclusion of any other purpose.

It is strictly forbidden to access and/or use and/or attempt to access or use the source codes or objects of the Application.

You do not acquire any intellectual property rights over the Application or its content, nor any rights other than those conferred by these GCU.

 

Article 5. FINANCIAL CONDITIONS

Ostend Airport is offered free of charge to users, excluding mobile phone operator subscription costs, Internet connection and access costs, and any additional costs charged for uploading data.

 

Article 6. INTELLECTUAL PROPERTY OF THE APPLICATION

The entire content of the Application is covered by French, European and international legislation on copyright and intellectual property.

All rights of reproduction and representation relating to the Application are reserved by UBIPLACE, owner of the mobile application, including all graphic, iconographic and photographic representations, whatever the territory of protection and whether or not these rights have been registered.

The reproduction and/or representation of all or part of the Application, whatever the medium, including all commercial names, brands, logos, domain names and other distinctive signs, is formally prohibited and would constitute an infringement punishable by the intellectual property code.

 

Article 7. CONDITIONS OF USE

The user expressly undertakes:

– to download Ostend Airport onto their equipment exclusively for professional use;

– not to reproduce Ostend Airport permanently or temporarily, in whole or in part, by any means and in any form;

– to notify emergency services in the event of imminent danger: call 17 for the police, 15 for the ambulance service and 18 for the fire service;

– not to use software or processes intended to copy the content without the prior written authorisation of UBIPLACE;

– not to adapt, modify, translate, transcribe, arrange, compile, decompile, assemble, disassemble, transcode or reverse engineer all or part of Ostend Airport, the services and/or the content;

– not to export Ostend Airport or merge all or part of Ostend Airport with other computer programs;

– to make only short quotations, analyses and reproductions for press reviews and other uses expressly authorised by law, within the limits and conditions set by law and subject in particular to quoting the names of the authors and the editorial source

– to refrain expressly from using software or devices likely to disrupt the proper functioning of Ostend Airport, or to take any action likely to impose a disproportionate burden on the infrastructure of UBIPLACE ;

– not to extract or re-use, including for private purposes, without prior written authorisation from UBIPLACE, any substantial or non-substantial part of the content of the databases and archives set up by Ostend Airport;

– not to set up systems likely to pirate Ostend Airport and/or the content in whole or in part, or likely to violate these GCU;

– to inform UBIPLACE as soon as they become aware of an act of piracy and in particular of any illicit or non-contractual use of Ostend Airport and/or the content, whatever the means of distribution;
– not to sell, rent, sub-license or distribute in any way whatsoever Ostend Airport and/or the content to third parties.

SECTION 8. CONFIDENTIALITY POLICIES

This Personal Data Management (PDM) policy describes the way in which your data is processed when using the UBIPLACE ‘Ostend Airport’ application.

This Personal Data Management Policy (DCP) describes how your data is processed when using UBIPLACE’s ‘Ostend Airport’ application, in compliance with European Regulation 2016/679 of 27 April 2016 on data protection (known as the ‘RGPD’), and Law No. 78-17 of 06 January 1978 as amended, relating to Information Technology, Files and Freedoms (known as the ‘Information Technology and Freedoms Law’).

UBIPLACE, in its capacity as data controller, is committed to protecting the privacy of individuals and undertakes to take all necessary steps to ensure a high level of protection for your personal data. It determines the purposes and means of the processing operations it implements.

Compliance with the rules governing the protection of personal data is a genuine factor of transparency and trust in your regard.

UBIPLACE’s personal data protection commitments

UBIPLACE undertakes to ensure that the processing of your personal data, carried out using its ‘Ostend Airport’ application, complies with the RGPD and the French Data Protection Act.

UBIPLACE undertakes to guarantee a high level of protection for your personal data.

UBIPLACE undertakes to process your personal data in a lawful, fair and transparent manner.

 

Each electronic form or teleservice limits the collection of PII to that which is strictly necessary for the purposes for which it is processed and clearly indicates :

 

  • the purpose of collecting your data;
  • the legal basis for processing;
  • whether this data is obligatory or optional for the management of your request, and the possible consequences of a failure to reply;
  • who will be able to access it;
  • how long the data will be kept;
  • your rights with regard to your data and how to exercise them with UBIPLACE.

 

Collecting your data for specific, explicit and legitimate purposes

Your personal data is collected for specific, explicit and legitimate purposes, always in connection with the public service missions pursued by UBIPLACE, and is not further processed in a manner incompatible with these purposes.

In this case, your personal data is processed by UBIPLACE in order to manage requests for information made using the ‘Ostend Airport’ mobile application and to manage the sending of information and invitations relating to the requests made. All your PCDs are anonymised for Ostend Airport users who have access to the application management platform.

Obtaining your prior consent

As part of the use of the ‘Ostend Airport’ application, the processing of your personal data is based on your consent, which you may withdraw at any time by sending an e-mail to the UBIPLACE Data Protection Officer (DPO): rgpd@ubiplace.com.

Before collecting your data, UBIPLACE ensures that your consent is free, specific, informed and unambiguous.

As part of the ‘reporting’ service of the ‘Ostend Airport’ mobile application, the use of your mobile phone’s GPS geolocation (location) functionality requires your prior and express consent to be geolocated. To do so, you must activate, if you wish, the geolocation function directly in the settings of your mobile terminal (this function may be deactivated or activated at any time and free of charge) and accept that the ‘Ostend Airport’ mobile application may have access to the geolocation of your mobile telephone, solely for the time of using the service. Your prior and express consent will be requested each time you connect to the service.

You may withdraw your consent at any time, without having to stop using the services offered by the ‘Ostend Airport’ mobile application.

Minimising the data collected

Your PII is collected in a way that is appropriate and relevant to the purposes for which it is collected.

Your PII is limited to what is necessary to achieve the purposes for which it is processed.

In this case, only your email address and/or the GPS geolocation of your telephone are likely to be processed by UBIPLACE for the purposes defined above.

Limited retention of your data

Your personal data will be kept for as long as is necessary for the purposes for which it was collected.

Your DCP is kept in accordance with data protection rules.

In this case, your PCDs are kept for 6 months from the registration of your request.

Your smartphone’s location data will be kept for as long as you need to access the ‘reporting’ service of the ‘Ostend Airport’ mobile application.

Guaranteeing appropriate security

UBIPLACE implements appropriate technical and organisational measures:

  • to guarantee a level of security appropriate to the risk inherent in its DCP processing operations;
  • in order to meet regulatory requirements for the protection of personal data;
  • to protect your rights and your data from the outset of processing operations.

Your personal data is processed in France.

Respecting your rights

In accordance with the RGPD and the French Data Protection Act, you may access your personal data and request that it be corrected or deleted.

You also have the right to port your data, the right to limit the processing of your data and the right to organise what happens to your data after your death.

To exercise your rights or if you have any questions about the processing of your data when using the UBIPLACE ‘Ostend Airport’ application, please contact the DPO: rgpd@ubiplace.com

You may lodge a complaint – either online or by post – with the CNIL if you feel – after contacting our DPO – that your rights have not been respected or that the processing carried out does not comply with data protection rules.

Article 9. APPLICATION OF THE GCU

The GCU are applicable to all users of Ostend Airport.

The user is invited to read carefully and at each visit the GCU which are accessible by clicking on the pictogram present on the pages of Ostend Airport and may be modified at any time and without notice by UBIPLACE.

Ostend Airport may be updated on a regular basis. In this respect, any application downloaded by a user has a limited validity in time, taking into account these updates which must be downloaded and any technical, legislative or regulatory changes, over which UBIPLACE has no control.

 

Article 10. AVAILABILITY OF THE APPLICATION

UBIPLACE undertakes to make its best efforts to secure access, consultation and use of the Ostend Airport services. Ostend Airport is accessible 24 hours a day, 7 days a week, except in cases of force majeure or the occurrence of an event beyond the control of UBIPLACE and subject to any breakdowns and maintenance operations necessary for the proper functioning of Ostend Airport.

 

Article 11. LIMITATION OF WARRANTY

Access to and use of Ostend Airport is at the user’s own risk.

Ostend Airport is provided as is and is available without warranty.

It is the responsibility of each User to take all appropriate measures to protect his/her own data and/or software stored on his/her computer and telephone equipment against any attack.

The User declares that he/she is aware of and accepts the characteristics and limits of the Internet network and, in particular, the functional characteristics and technical performance of the Internet network; problems related to connection and/or access to the Internet network and/or websites; problems related to network availability and congestion; problems related to network failure or saturation; problems relating to transit time, access to information posted online, response times for displaying, consulting, querying or otherwise transferring data; risks of interruption; lack of protection of certain data against possible misappropriation or piracy; risks of contamination by any viruses circulating on the said networks, etc., for which UBIT is not responsible. for which UBIPLACE cannot be held responsible.

UBIPLACE cannot be held responsible :

– in the event of failure, loss, delay or error in the transmission of data which is beyond its control ;

– the sending of messages and/or data to a false, erroneous or incomplete address;

– if data is not received for any reason whatsoever, or if the data received is illegible, incomplete or impossible to process;

– if the user is unable to access or use Ostend Airport for any reason whatsoever;

– if, for any reason whatsoever, the connection is interrupted.

Furthermore, UBIPLACE declines all responsibility in the event of misuse of the terminal and/or any incident linked to the use of the terminal when using Ostend Airport. UBIPLACE cannot be held responsible for any damage of any nature whatsoever caused to users, their terminals, their computer and telephone equipment and the data stored therein, nor for any consequences that may arise from this on their personal, professional or commercial activity.

 

Article 12. CHANGES TO THE GENERAL TERMS AND CONDITIONS OF USE

The GTCU applicable are those in force on the date of connection to and use of Ostend Airport by the user.

UBIPLACE reserves the right to modify, at any time, all or part of the provisions of the GCU without prior notice or information to users in order to adapt them to changes in services, technical developments, legal or jurisprudential developments or when new services are introduced.

Any changes made by UBIPLACE to the GCU will be brought to the attention of users simply by posting them online. They are deemed to be accepted without reservation by any user who accesses Ostend Airport after said posting. UBIPLACE therefore invites all users to consult the GCU on a regular basis.

Any new service incorporating new techniques or new features improving the quality of existing services will also be subject to these GCU, unless expressly provided otherwise.

 

Article 13. TERMINATION OF THE APPLICATION

UBIPLACE may terminate the use of Ostend Airport at any time by giving notice of termination to the user if the TOS are not complied with.

Upon any termination, the rights and licenses granted to you will be terminated and you must cease all use of Ostend Airport.

ARTICLE 15. APPLICABLE LAW

These GCU are governed by French law.

Any dispute or disagreement relating to the performance or interpretation of these rules that cannot be settled amicably between the parties will be submitted to the competent courts of the Nice administrative tribunal.
